This Privacy Policy applies to the use of Panasonic TV Skill or Panasonic TV Action (each, a “Service”, and collectively, the “Services”) that are operated and provided by Panasonic Entertainment & Communication Co., Ltd. having its registered office of 1-10-12, Yagumo-higashi-machi, Moriguchi City, Osaka 570-0021, Japan (including its Affiliates, hereafter collectively “Panasonic”, “we”, “us” or “our”) and accessed by means of a Panasonic-branded audio visual product with internet connection (including a smart phone or tablet PC (hereinafter “Services”). Panasonic is represented in the European Economic Area (i.e. the European Union, Iceland, Liechtenstein and Norway) for any data protection related matters by its German entity, Panasonic Business Support Europe GmbH, having its registered office at Hagenauer Straße 43, 65203 Wiesbaden, Germany.

The purpose of this Privacy Policy is to inform you how and why we use and collect information about you (referred to in this Privacy Policy as “Personal Data”, as further defined in Section 1 below) when you use the Services. It also explains what your rights and our obligations are in relation to the processing of your Personal Data, in accordance with the European data protection legislation and, as from 25 May 2018, the General Data Protection Regulation (the “GDPR”).

This Privacy Policy does not apply to information that may be collected by or through third party applications that are available through the Services. To the extent the Services may be used by other members of your household or your visitors, we invite you to provide those other users with this Privacy Policy.

1. What is Personal Data?

For the purposes of this Privacy Policy, “Personal Data” consists of any information that relates to an identified or identifiable individual (such as you). For example, information which identifies you may consist of your name, address, telephone number, photographs, payment details, a specific Panasonic product/device identification number that you purchased, location data, an online identifier (e.g., cookies and your IP address). Information which does not identify you on its own but that we link to you also qualifies as Personal Data.

2. What Personal Data does Panasonic collect about you?

A. Personal Data you provide directly about yourself.

You can use your TV without providing any Personal Data by not connecting your TV to the Internet. However, to enable you to benefit from the Services and certain features within some Services, you will need to connect your TV to the Internet and we will request Personal Data from you. You can choose whether or not to provide this information, but you may not be able to access our full Services if you choose not to submit it. We have detailed below the circumstances where we collect your Personal Data in relation to the Services:

  1. To access some Services or functions within Services you will need to register with us and enter a username and password (“Panasonic ID”). If you choose to use Services and do not yet have a Panasonic ID, we will ask you create one and comply with the related Terms and Conditions accessible at https://csapl.pcpf.panasonic.com/Agreement/ShowDocuments?docId=pf00010001. In addition, you will be invited to read and acknowledge the related Privacy Policy accessible at https://csapl.pcpf.panasonic.com/Agreement/ShowDocuments?docId=pf00010002.
  2. If you contact us or interact with our customer support representative to troubleshoot problems you are having with the Services, we may ask you to provide certain additional information, including your name, mailing address, phone number, email address, contact preference, unique device identifier and model number of your device.

B. Personal Data from third party sources

If you use the Services, we will receive Personal Data relating to you from third parties. Depending on whether you use the Panasonic TV Skill (which connects the TV to Amazon’s Echo) or Panasonic TV Action (which connects the TV to Google Home), we will receive Personal Data relating to you from Amazon or Google respectively. This includes your Google Home or Amazon Echo account (as applicable) and the commands that you address to your TV.

If you choose to install an application provided by a third party or purchase a third party product(s) or applications on your TV, this transaction may be processed by a third party company that may ask you to provide certain information. Any information such third party company gathers will be governed by its own privacy policy.

C. Information about your use of the Services

In addition to the information that you provide to us, we automatically collect information about the Services that you use and how you use them via your Panasonic-branded TV, namely:

  • Device/product information-this includes your hardware model, IP address of your device’s wireless network interface, user identifier, unique device identifier, device configurations, firmware version, and device, service and application usage data. Please note that the IP address of your device’s wireless network interface will be collected as soon as you connect your TV to the Internet.

3. On which legal basis do we process personal data?

We are not allowed to process Personal Data if we cannot rely on a valid legal ground. Therefore, we will only process your Personal Data when:

  1. the processing is necessary to perform our contractual obligations towards you or to take pre-contractual steps at your request;
  2. the processing is necessary to comply with our legal or regulatory obligations; or
  3. the processing is necessary for our legitimate interests except where they are overridden by your interests or fundamental rights and freedoms. Examples of such ‘legitimate interests’ include:
    1. (i) to benefit from cost-effective services (e.g. we may opt to use certain platforms offered by suppliers);
    2. (ii) to protect the security of our IT systems, architecture and networks; and
    3. (iii) to meet our corporate and social responsibility objectives.

4. Why do we use your Personal Data?

We will use your Personal Data for the following purposes:

  1. To register you and your device or product for the Services, in particular, to connect your Panasonic ID and the information relating to your device with your Amazon Echo or Google Home account (as applicable) to make sure your commands are properly communicated to your TV;
  2. To upload the latest version of this Privacy Policy in the TV;
  3. To provide the Services;
  4. To provide customer support service for the Services or to deal with any other support queries you may have (such as compliant handling);
  5. To analyse, improve, enhance and personalize the Services;
  6. To abide by the laws of the European Union and of its Member States on the basis of our Legal Obligations. We reserve the right to access, process and disclose any information that we reasonably believe is necessary to comply with the laws of the European Union or one of its Member States or to comply with an order from a court, public authority or competent regulator of the European Union or one of its Member States;
  7. To enforce or apply our Terms of Use and other agreements; investigate, prevent or take action regarding illegal activities or suspected fraud; or protect the rights, property or safety of the Company, our employees, our users or others.
  8. to protect our customers (e.g. to prevent spam or attempts to defraud users of our Services); to operate and maintain the security and integrity of our Services (e.g. to prevent or stop an attack on our systems or networks); or to protect the rights or property of Panasonic, including enforcing any terms or agreements governing the use of our Services; and
  9. to manage corporate transactions involving our company, including reorganization, merger, transfer, sale, joint venture, assignment or other disposition of all or any portion of Panasonic's business, assets or stock, including, without limitation, in connection with any bankruptcy or similar proceeding.

5. To whom and where do we disclose your Personal Data?

We may disclose your Personal Data to the entities listed in this Section 5. We require these third parties to take steps to maintain the confidentiality of any Personal Data they may receive from us to perform their functions, consistent with our Privacy Policy, and they may not use those information for any other purpose. We may also disclose your information as follows:

  1. Panasonic Affiliates
    We may need to transfer your Personal Data to other Panasonic Affiliates to provide the Services you require or any other services/assistance. All Panasonic Affiliates are required to follow the privacy practices set forth in this Privacy Policy. In this Privacy Policy, “Affiliates” shall mean any corporate entity that directly or indirectly controls, is controlled by or is under common control with Panasonic Entertainment & Communication Co., Ltd.
  2. Service Providers
    We share Personal Data about you with third party service providers solely for the purpose of enabling them to perform services on our behalf and they will operate only in accordance with our instructions. Here are examples of third-party service providers we use:
    • Analytics Service Providers – analytics providers are used to assist us in understanding the usage of our products/devices and other Services, to enable us to improve our Services. The analytics providers we currently use are Google Analytics. For further information see the “Cookie” section of this Privacy Policy.
    • Voice Assistant Service Providers-voice assistant service providers are used to enable the usage of voice control on our products/devices and of the Service. The voice assistant service providers we currently use are Google Assistant and Amazon Alexa.
  3. Third parties when required by Law or to protect our Services
    We will disclose your Personal Data to comply with applicable Member State or European Union law or respond to valid legal process, including from law enforcement or other government agencies
  4. Other Parties in Connection With Corporate Transactions
    We may disclose your Personal Data to a third party (or other Panasonic Affiliate) as part of a reorganization, merger, transfer, sale, joint venture, assignment or other disposition of all or any portion of Panasonic's business, assets or stock, including, without limitation, in connection with any bankruptcy or similar proceeding.

6. Where do we store your Personal Data?

The Personal Data that we collect from you may be stored and processed in your region, or transferred to, stored at or otherwise processed outside the European Economic Area (“EEA”), including but not limited to, Hong Kong and Japan or in any other country which does not offer an adequate level of data protection as recognized by the European Commission and where Panasonic or its Affiliates, subsidiaries or service providers maintain facilities.

Where we transfer your Personal Data outside the EEA, we will ensure that suitable safeguards are in place to help ensure that our third party service providers provide an adequate level of protection to your Personal Data. In the case at hand, we have put in place an appropriate transfer agreement incorporating the Standard Contractual Clauses approved by the European Commission. You may request additional information in this respect and obtain a copy of the relevant safeguards upon request through sending a request to the contact indicated in section 8 below.

7. What do we do to keep your Personal Data secure?

Panasonic maintains physical, technical, and procedural safeguards to keep the Personal Data we collect in connection with the Services secure. To the extent we have your Personal Data, we restrict access to such information to those persons who need to know that information to provide products or services to you and any persons you have authorized to have access to such information.

However, please note that although we take appropriate steps to protect your Personal Data, no website, product, device, online application or transmission of data, computer system or wireless connection is completely secure and therefore we cannot guarantee the security of your Personal Data.

8. What are your rights and how can you exercise them?

A. What are your rights?

Panasonic will collect, store and process your Personal Data in accordance with your rights under any applicable data protection laws.
Your rights under the GDPR include, the right to access a copy of your Personal Data, the right to request the correction or the updating of any inaccurate Personal Data and the right to object to the processing of your Personal Data under the conditions set out in the GDPR.

You also have the right to request the erasure of your Personal Data and – where you have consented to the processing of your Personal Data, you have the right to withdraw such consent at any time (without this withdrawal affecting the lawfulness of the processing prior to such withdrawal).

In addition, you also have the right to data portability in certain cases. This is the right to request the return of the Personal Data you have provided to us in a structured, commonly used and machine-readable format and to request the transmission of such Personal Data to a third party, without hindrance from us and subject to your own confidentiality obligations.

We will respond to your request without undue delay and no later than one month from receipt of any such request, unless a longer period is permitted by applicable data protection laws. Please note that we will only charge a fee where we are permitted to do so by applicable data protection laws.

C. Complaints

If you are not satisfied with how we process your Personal Data, you may also file a complaint with the competent supervisory authority, in addition to your rights outlined above.

D. How to change the settings of your TV to stop the collection of your Personal Data?

In addition to the above, you can stop the Services and the collection of Personal Data. If you wish to do so, you can do it by:

  1. (i) accessing the following (https://www.tvpa.panasonic.com/) and login with your Panasonic ID,
  2. (ii) clicking the tab of “Terms & Condition” at the bottom of the page,
  3. (iii) clearing the check box for “I agree to Terms & Conditions” and click “OK”, and
  4. (iv) clicking the “OK” when and where the message appeared.

9. How long do we store your Personal Data

We will retain your Personal Data for three (3) years after you stop using our Service.

10. Third-Party Links and Product on Our Services

The Service may include links to applications from third party developers that are not operated by Panasonic. These applications are not under Panasonic’s control and as such, we are not responsible for the privacy practices or the content of these applications. If you choose to use any third party applications, any Personal Data collected by the third party’s website or application will be subject to any existing privacy policy of that third party. We strongly recommend that you take the time to review the privacy policies provided by these developers to which you provide Personal Data.

11. Children’s Personal Data

  1. Do we collect Personal Data from children?
    We do not knowingly collect or try to collect Personal Data from or about children (as this concept is interpreted under applicable law) without the consent of a parent or guardian. Where we do collect Personal Data from children, we will always use reasonable efforts to verify that consent has been given or authorized by the child’s parent or guardian.
  2. What do we do when children submit Personal Data to us?
    If we become aware that Personal Data submitted to us related to a child without consent of a parent or guardian, we will use reasonable efforts to:
    • delete that Personal Data as soon as possible: or
    • if deletion is not possible, we will ensure that the Personal Data is not used for any purpose, nor disclosed to any third party.
  3. Parent or guardian queries.
    If you are a parent or guardian and you have queries regarding Panasonic’s processing of your child’s Personal Data, please contact us using the details provided in Section 8.

12. Changes to this Privacy Policy

We may change this Privacy Policy from time to time. The “Date last updated” mentioned at the bottom of this pages states when the policy was last updated and any changes will become effective upon our posting of the revised Privacy Policy. Where required by applicable law, we will request your consent to any such changes. We will provide this notice by e-mail if you have provided your email address or by posting a notice of the changes on this page or through any relevant Services.

13. Cookies and similar technologies

When registering with us to access some Services or functions within Services, you will be directed to a website where you will be requested to provide your Panasonic ID.
